These Terms of Service ("Terms") are an agreement between you and OpenSchool ("we", "us") about your household's use of Luna and the OpenSchool platform (the "Service") and everything made available through it, including questions, explanations, worked examples, whiteboard content, reading passages, images and other learning materials (the "Materials"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Your account
OpenSchool is designed for children to use under the direction of a parent or legal guardian. You must be at least 18 years old to create an account. By creating one, you confirm that you are the parent or legal guardian of each child who uses it, you agree to these Terms on your own behalf and on behalf of your child, and you consent to our collection and use of your child's information as described in our Privacy Policy and Children's Privacy Notice.
You are responsible for the information you give us, for keeping your password secure, and for your child's use of the Service. Please give accurate details and tell us if they change. The account is for your household's personal, non-commercial use and cannot be transferred or shared outside it.
2. Subscriptions, trial and payment
Free trial. New accounts start with a 7-day free trial. We ask for a payment card when you start the trial, but you are not charged during it. If you do not cancel before the trial ends, your subscription begins and your card is charged for the plan you chose.
Plans. We offer plans that differ in how many hours of tutoring your child can use each week. Current plans and prices are shown at sign-up and on our pricing page. Prices are in US dollars, or Australian dollars for customers in Australia, and include applicable taxes unless we say otherwise.
Renewal. Subscriptions renew automatically at the end of each billing period, monthly or yearly depending on your plan, until you cancel. We will charge the card on file at the then-current price for your plan. If we raise the price of your plan, we will tell you by email at least 30 days before it takes effect, and you can cancel before then.
Canceling. You can cancel at any time from Billing inside the app, which takes you to our payment provider's portal. Canceling stops future charges. Your child keeps access until the end of the period you have already paid for. Canceling is as easy as signing up and never requires you to call or email us, though you are welcome to.
Refunds. If OpenSchool is not right for your family, email us within 14 days of your first charge and we will refund it in full. After those 14 days we do not refund payments already made, on monthly or yearly plans. You can cancel at any time and your access continues to the end of the period you have paid for. Nothing in this section limits rights you have under the consumer protection laws where you live, including the Australian Consumer Law for customers in Australia.
Promotional pricing. If we offer you a discounted first month or other introductory price, it applies to the first billing period only. Your subscription then renews at the normal price for your plan, which we show you before you accept the offer.
Weekly hours. Each plan includes a set number of tutoring hours per week. When they are used up, lessons pause until the week resets or you move to a larger plan. Unused hours do not roll over.
3. Using Luna appropriately
Luna is for learning. Your child may ask questions, work through problems, read and listen to Luna's explanations, and use the Materials for their own study. You and your child must not:
- use the Service to generate content that harasses, threatens, sexualizes or demeans anyone;
- attempt to disrupt the Service, access it without authorization, or probe its security;
- copy, resell, redistribute or publish the Materials beyond your own household's study;
- use any bot, scraper or automated tool to access or collect the Materials or any data from the Service; or
- use the Service or the Materials to train, fine-tune, evaluate or improve any artificial intelligence or machine-learning system, or feed the Materials into any third-party AI tool.
We reserve all rights in the Service and the Materials, including rights to text and data mining, and we opt out of any exception that would otherwise permit it. Breach of this section is a material breach of these Terms and may result in immediate termination.
If your child uploads a worksheet, photo or document, you confirm that you have the right to use it this way and that it does not contain personal information about anyone outside your household.
If Luna ever says something harmful or inappropriate to your child, please report it from inside the app or email support@openschool.ai. We review every report.
4. Content and ownership
The Service and the Materials belong to us or our licensors and are protected by intellectual property law. You receive a limited, personal, revocable license to use them for your household's study.
What your child creates in Luna stays yours. You give us the license we need to run the Service: to store your child's work and lessons, send them to our AI and speech providers to generate Luna's responses, show them back to your child, and report progress to you. The Privacy Policy and Children's Privacy Notice describe this in detail.
If you send us suggestions or feedback, we may use them to improve the Service without any obligation to you.
5. Homeschooling with OpenSchool
OpenSchool is a curriculum and tutor, not a school. We are not an accredited school, a school of record or an education authority. We do not enroll students, issue diplomas, transcripts or attendance records, or certify that a child has met any legal requirement. You remain your child's homeschooling parent, and OpenSchool is a tool you use to do that.
You are responsible for complying with your homeschooling laws. Requirements for homeschooling differ by state and country and may include registering or notifying an authority, teaching particular subjects, keeping records, meeting minimum hours or days, and periodic assessment. It is your responsibility to know and meet the rules that apply to you. Our progress reports can help you keep records, but we do not promise that they satisfy any authority's requirements.
Our standards mapping is our own. Luna's lessons are mapped by us to published standards, including the Common Core State Standards, the Next Generation Science Standards and the C3 Framework for Social Studies. Those organizations have not reviewed or endorsed OpenSchool. Standards and state requirements change, and your state's may differ from the ones we follow. You decide whether OpenSchool's curriculum is right for your child and meets your obligations.
Two hours a day. OpenSchool is designed so that a child who completes their planned lessons for about two hours each school day can cover a full grade's curriculum in a school year. How far your child progresses depends on them actually doing the lessons, on their starting level, and on your involvement. We do not guarantee that any child will reach a particular level or keep pace with any school or standard.
6. What Luna is and is not
Luna is an AI tutor and a study aid. We work hard on accuracy and on good teaching, but Luna can be confidently wrong about a fact, a method or a step, and we do not guarantee any particular learning outcome. Please check anything important against other sources, and do not rely on Luna for medical, legal, financial or other professional advice.
Luna is not a replacement for adult supervision. We recommend that a parent or guardian stays aware of what their child is learning and reviews their progress reports.
Luna is a tutor, not a counselor or emergency service. If your child needs help with anything other than their schoolwork, please make sure they know to talk to you or another trusted adult.
We may change, add or remove features of the Service as we improve it. If we ever discontinue the Service, we will give you reasonable notice and refund any prepaid period you have not used.
The Service is provided "as is" to the extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, OpenSchool will not be liable for indirect, incidental or consequential loss arising from use of the Service, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits rights you have under the consumer protection laws where you live that cannot be excluded, including the Australian Consumer Law for customers in Australia.
8. Ending your account
You may stop using the Service at any time. To cancel your subscription, see section 2. To delete your account and your child's information, email support@openschool.ai from the address on the account and we will erase it as described in the Privacy Policy.
We may suspend or end access immediately if you or your child breach these Terms, or use the Service in a way that could harm us, other families or our providers. If we end your access for a reason other than breach, we will refund any prepaid period you have not used.
9. Governing law
These Terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state. If you live in the United States, nothing in this section takes away consumer protections you have under the laws of your state.
10. Changes to these Terms
We may update these Terms. We will post the new version here and update the date above. If a change materially affects your rights or what you pay, we will email you at least 30 days beforehand. Continuing to use the Service after a change takes effect means you accept it.
11. General
These Terms, the Privacy Policy and the Children's Privacy Notice are the whole agreement between you and us about the Service. If any part of these Terms is found to be unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your account or these Terms to anyone else. We may transfer them to a successor who takes over the Service, and we will tell you if we do. You agree that we may send you notices and other communications about your account by email to the address you gave us.
